          Eric R. de Vries is advocaat bij het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba en als partner verbonden aan HBN Law met kantoren in Aruba, Bonaire, Curaçao en St. Maarten. Zijn praktijk concentreert zich op vastgoed, infrastructuur, telecom en financieringen. Hij is geboren en getogen op Curaçao, volgde zijn rechtenstudie aan de KUB (nu UvT) in Tilburg en de Universidad de Barcelona en werkte als advocaat bij het kantoor van de Landsadvocaat, Pels Rijcken & Droogleever Fortuijn in Den Haag. In deze artkelen, die hij op persoonlijke titel schrijft, bericht hij over de vaak toch wel heel interessante en mooie (en soms minder mooie) dingen op juridisch gebied in de West.

          Karel is a partner at Spigthoff Attorneys at Law & Tax Advisers and President of the Curacao Bar Association. He graduated from the VU University (Amsterdam) in 1989 in both civil law and notarial law. He is an attorney as from 1989. Specialties are a.o. corporate law, banking & securities law and e-commerce. Karel is an experienced litigator: what he advises as a business lawyer, he is prepared to defend in court. Also, as a lobbyist he is trying to help, for instance, foreign companies, financial institutions and trade associations.

          Karel is a frequent commentator on corporate and securities case law developments and (co-)author of numerous books and articles on various aspects of Dutch and Netherlands Antilles law, and he has also served as a lecturer at the University of the Netherlands Antilles on Conflict of Laws (international private law). Karel is the author of the leading legal text book on Netherlands Antilles and Aruba corporate law (2nd edition 2006; 340 pages). On his website Karel's Legal Blog (www.curacao-law.com) he regularly writes comments on different legal subjects, both in English and in Dutch.

Na afronding van haar rechtenstudie in Leiden is zij teruggekeerd naar de Antillen waar zij als advocaat is gaan werken bij HBNLaw op Curaçao en Sint Maarten.       The Joint Court of Justice of the Netherlands Antilles and Aruba is responsible for the administration of justice in first instance and in appeal in the islands of the Netherlands Antilles and in Aruba. The Joint Court of Justice consists of a presiding judge and the other members and their substitutes. The members of the Joint Court of Justice deal, in first instance and in appeal, with civil cases, criminal cases, and cases of administrative law (among others, tax law).

      The Court in First Instance
      A case that is dealt with in court for the first time generally falls under the jurisdiction of the Court in First Instance, which is an organizational part of the Court of Appeal. Cases in first instance are generally dealt with by one judge. The Court in First Instance of the Netherlands Antilles has its seat in Curacao and has jurisdiction in all the islands of the Netherlands Antilles. There are also sessions in all the islands. Besides this, there is a Court in first Instance for Aruba that is also part of the Court of Appeal.

      Cases in Appeal
      The Joint Court of Justice of the Netherlands Antilles and Aruba handles cases in appeal that were dealt with and decided on by the Courts in First Instance. A judge who handled a case in first instance will not participate when the case is dealt with in appeal. The cases in appeal are dealt with by three members of the Court. Those judges then make up the Joint Court of Justice of the Netherlands Antilles and Aruba. So, this name denotes both the whole of the judicial system of the Netherlands Antilles and Aruba (including the Courts in First Instance) as well as the higher court of appeal by itself (hereafter ‘the Court of Appeal’).There are some exceptional cases where the Court of Appeal also handles cases in first instance with more than one judge.

      Judicial tribunals
      The members of the Joint Court of Justice of the Netherlands Antilles and Aruba also work together in judicial tribunals, such as the Board of Appeal in the Arbitration Court for Civil Servants and the Board of Appeal in Tax Cases.
