Woman sentenced for illegal abortion

PHILIPSBURG--The Court of First Instance sentenced a 33-year-old woman Wednesday to six months suspended, on two years' probation for illegal abortion. The woman was tried in absentia.
 
Her lawyer Geert Hatzmann said he believed the woman, who had been working at one of St. Maarten's adult entertainment centres, had in the meantime returned to the Dominican Republic.
 
Prosecutor Maarten Noordzij told the Judge the woman had panicked after a client had accidentally impregnated her by a torn condom.
 
The mother of three daughters did not want to deliver the man's baby. "She didn't even know the man's first name," the Prosecutor said.
 
The desperate woman had turned for help to a gynaecologist, who had declined to perform an abortion. She then decided to take a number of antacid pills she had brought with her from the Dominican Republic.
 
She reported herself at St. Maarten Medical Center (SMMC) with severe bleedings and cramps. These led to the unborn baby's death on October 24, 2013.
 
The woman was treated at SMMC and received assistance from Mental Health Foundation, the Prosecutor said.
Prosecutor Noordzij said abortion is not permitted in St. Maarten and is punishable by law.
 
He said the fact that the woman got pregnant from an unknown customer was a mitigating circumstance. "However, I do want to give out a signal to indicate that abortion is not permitted here," said Noordzij in requesting the Court to impose six months suspended.
 
Judge Koos van de Ven said this was a very sad case. He followed the Prosecutor in his demand.
