Pre-trial detention of 18-year old woman suspended

PHILIPSBURG - The 18-year-old woman, J. B. R., who is suspected of assaulting a 14-year-old girl, is released from her pre-trial detention yesterday March 31, 2015.
 
The woman was arrested on Friday, March 27th, 2015, after the victim pressed charges of mistreatment against her the previous day. 
 
The assault has caused commotion since this was filmed and posted on social media.
 
The Prosecution considers the assault as a serious offense, but the personal circumstances of the suspect have been decisive for the suspension of the pre-trial detention. The suspect is of a young age, she has no criminal record and has not been involved in fights or aggression at school before. Also is taken into account that the suspect, already on Monday after the brawl, reported herself to the police. 
 
She has fully cooperated with the investigation.
 
Given those circumstances, the prosecutor advised the judge of instruction to suspend the pre-trial detention under certain special conditions. The accused must visit the probation service and cooperate in the creation of a psychological and/or psychiatric report. The judge followed this and also imposed a prohibition on contact with the victim. The school will make it possible for the suspect to make her exams. The suspect will be under the supervision of the “reclassering” (probation), at least until the court hearing. It is not yet known when the court hearing will take place.
 
In anticipation of its future role as an office of victim care, the prosecution asked the Court of Guardianship to start a conversation with the young victim and her family. They shall look in to the possibility of mediation. 
 
In the meantime, the police will continue to investigate the brawl. They will investigate who has filmed the fight and who encouraged it. The prosecution emphasizes that the filming a fight under circumstances is punishable ("happy slapping"). Also encouraging a fight may be punishable. It is always better to try to stop a brawl or to get help.
 
 
Voorlopige hechtenis van 18-jarig meisje is opgeschort
 
De 18-jarige vrouw, J.B. R., die verdacht wordt van de mishandeling van een 14-jarig meisje, is gisteren 31 maart 2015 vrijgelaten uit haar voorlopige hechtenis. De vrouw was op vrijdag 27 maart 2015, nadat de dag ervoor aangifte was gedaan van mishandeling, aangehouden. De mishandeling heeft voor ophef gezorgd nu deze is gefilmd en op social media is geplaatst.
 
Het Openbaar Ministerie meent dat er sprake is van een ernstig feit, maar de persoonlijke omstandigheden van de verdachte hebben de doorslag gegeven voor haar schorsing. De verdachte is van jonge leeftijd, zij heeft geen strafblad en zij heeft niet eerder agressiviteitsproblemen op school vertoond. Belangrijk is ook dat zij, op maandag na de vechtpartij, zichzelf reeds had gemeld bij de 
politie. Zij heeft volledige medewerking aan het onderzoek verleend.
 
Gelet op die omstandigheden heeft het OM de rechter-commissaris geadviseerd de voorlopige hechtenis te schorsen onder bepaalde bijzondere voorwaarden. De verdachte moet zich melden bij de reclassering en meewerken aan de totstandkoming van een psychologisch en/of psychiatrisch rapport. 
 
De rechter-commissaris heeft dit standpunt gevolgd en daarnaast een contactverbod met het slachtoffer opgelegd. De verdachte zal door haar school in de gelegenheid worden gesteld om haar examens te maken. Zij zal voorts tot aan de zitting onder toezicht blijven staan van de reclassering (SJIB). 
 
Het is nog niet bekend wanneer de zitting zal plaatsvinden.
 
Vooruitlopend op haar toekomstige taak als Bureau Slachtofferzorg is de Voogdijraad door het OM verzocht om in gesprek te gaan met het minderjarige slachtoffer en haar familie. Onderzocht wordt of een vorm van herstelbemiddeling mogelijk is.
 
In de tussentijd zal de politie verder gaan met het onderzoek naar de vechtpartij. Zo zal onderzocht worden wie de vechtpartij heeft gefilmd en wie de vechtpartij heeft aangemoedigd. Het OM benadrukt dat het filmen van een vechtpartij onder omstandigheden strafbaar is (“happy slapping”).
 
Ook het aanmoedigen van een vechtpartij kan strafbaar zijn onder de bepalingen van openlijk geweld. Het is altijd beter om de vechtpartij te proberen te stoppen of om hulp te halen.
