Court of Appeal rules in case Alegria against timeshare owners Caravanserai

WILLEMSTAD - Today the Court of Appeal ruled in the case of Alegria Real Estate B.V. against the timeshare owners at Caravanserai association in Sint Maarten. The Court of Appeal decided to suspend the enforceability of the judgment of the Court in First Instance of August 21, 2015.
 
In the judgment that has now been suspended, Alegria was ordered to allow the members of TOCA to access units at the former Caravanserai Beach Resort on pain of a penalty and Alegria was also ordered to pay damages to the members of TOCA.
 
In short, the Court of Appeal considered that there is a risk that Alegria would not receive restitution in the event it would pay the awarded amount to the TOCA members and the judgment will be overturned, because all TOCA members reside outside Sint Maarten.
 
In addition, the Court of Appeal ruled that the interests of Alegria to suspend the enforceability of the judgment weigh heavier than those of Toca to enforce it.
 
 
In this case Alegria Real Estate B.V. was represented by attorneys Chris van Amersfoort, Chris de Bres and Eric de Vries of HBN Law.
The timeshare owners at Caravanserai association were represented by lawyers Mark Kortenoever and Martyn Schellekens of Lexwell Attorneys at Law.
