Government St. Maarten must make plan to improve conditions in prison

PHILIPSBURG - The Point Blanche Inmates Association has argued that the situation in the prison is very unsafe and that the circumstances are so poor that intervention by the Courted is needed.
 
Lawyers for the Pointe Blanche Inmates Association were Sjamira Roseburg and Shaira Bommel of Sulvaran & Peterson. The Inmates Association was represented by President Antonio Joseph, Vice-President Aliston Fleming, Secretary Nickerson Boireau and Treasurer Nestor Sanchez.
 
According to the inmates it is urgently warranted that security measures be put in place, that facilities and daytime activities are improved, that medical care is made more available and that access of lawyers is improved. The Inmates Association has filed a total of 15 claims to that effect.
 
Government lawyer and Dean of St. Maarten Bar Association Aernout Kraaijeveld acknowledged that Pointe Blanche Prison is in crisis. According to Kraaijeveld, Government stakeholders, such as the Ministry of Justice, the Law Enforcement Council, the Police Force of St. Maarten and the unions are making plans to remedy the situation.
 
The Country Sint Maarten thinks it should be left to the Minister and the prison’s new management to come up with an action plan to adequately address the current crisis in the prison. It is up to the Minister to set priorities without outside pressure. The Court should not take over the role of the Executive Branch. Many of the claims that are put forth are unrealistic and too broadly formulated, argues Country Sint Maarten.
 
The Court agrees that it is not the Court’s job to manage the prison. However it is possible that urgent circumstances, and the consideration of all interests involved, demand that measures be taken in the form of a Court Injunction. In this case, the Court had to evaluate if the situation in the prison is so urgent and so far removed from being in accordance with the law, that provisions aimed to end the unlawfulness need to be put in place. The Court to that effect carefully weighs all interests at stake and also pays attention to the degree to which the provisions can actually be executed. Furthermore, the Court has taken into consideration the ‘period of normalization’ of three months that was repeatedly mentioned by Country Sint Maarten.
 
The findings of the European Committee for the Prevention of Torture (ECT), the reaction to those findings given by Country Sint Maarten and the most recent report of The Law Enforcement Council have played an important role in the Court’s decision. These documents show that for the last 10 years signals of major concern about the situation in the prison have been given, and that Country Sint Maarten has not kept its repeated promises to follow up on recommendations given.
 
The Court’s evaluation of all facts and circumstances has led to the following provisions:
- Prison guard shifts are to be executed by at least six prison guards and shifts are not to last longer than eight hours;
- Prison guards are to receive professional training;
- Inmates are to follow an educational program, starting with the young adults;
- Inmates are to be timely informed of their release date;
- A public telephone, laundry machine and books are to be provided in the prison;
- Arrangements are to be made for a dentist to regularly visit the prison;
- Medical costs for the treatment on referral by a specialist doctor are to be covered and
- Laywers are to be given acces to their clients with on Thursdays with and they are to announce their visit one hour ahead of time.
 
Denied, for various reasons, are the claims pertaining to the suspension of the prison director, the Police Station, cell searches, two-on-one-cell, separating inmates, labour for women and a 10% reduction of punishment/prison time.
 
De Point Blanche inmates Association vindt de situatie in de gevangenis zo onveilig geworden en de omstandigheden zo erbarmelijk dat zij aanleiding heeft gezien dit aan de rechter voor te leggen.
 
Het is volgens de inmates dringend nodig dat er veiligheidsmaatregelen worden getroffen, dat de faciliteiten en dagbesteding worden verbeterd, dat de medische zorg beter wordt geregeld en dat de toegang van de advocaten wordt verruimd. De Inmates Association heeft in totaal 15 vorderingen ingesteld.
 
Volgens het Land moet het aan de Minister en het nieuwe management team worden overgelaten om een plan van aanpak op te stellen en uit te werken om de bestaande crisis in de gevangenis op te lossen. 
 
Welke prioriteiten daarbij worden gesteld moet de Minister zonder druk van buiten kunnen bepalen. De rechter moet niet op de stoel van het bestuur gaan zitten. Veel van de vorderingen zijn niet realistisch en te algemeen volgens het Land.
 
Het Gerecht onderschrijft dat het niet aan de rechter is om de gevangenis aan te sturen. Urgentie en een belangenafweging kunnen het echter toch nodig maken dat de kort geding rechter voorlopige voorzieningen treft. De rechter heeft in dit Geding moeten beoordelen of er sprake is van een (dreigende) onrechtmatige situatie die zo ernstig en zo spoedeisend is dat het treffen van voorzieningen (geboden en veroordelingen, in dit geval) nodig is om die onrechtmatigheid weg te nemen. Daarbij weegt de rechter de belangen en kijkt de rechter naar de uitvoerbaarheid van de te treffen voorzieningen. De rechter heeft bij de te treffen voorzieningen acht geslagen op de herhaaldelijk door gedaagde genoemde ‘normaliseringsperiode’ van drie maanden.
 
Belangrijk voor de beoordelingen zijn geweest de bevindingen van European Committee for the Prevention of Torture (ECT), de destijds daarop gegeven reactie van het Land, en het laatste rapport van de Raad voor de Rechtshandhaving. Daaruit blijkt dat al 10 jaar zorgelijke bevindingen zijn vastgesteld over de toestand in de gevangenis, en dat het Land steeds heeft beloofd aanbevelingen op te volgen maar dat niet heeft gedaan.
 
De uitkomst van de door de rechter gemaakte belangenafweging heeft geleid tot het treffen van voorzieningen
 
- Om de diensten van de bewaarders weer voldoende bemand te krijgen: zes bewaarders per dienst en diensten van niet langer dan acht uur
 
- Om de bewaarders de nodige opleiding te laten volgen
 
- Om voor te beginnen met een opleidingsprogramma, eerst voor de jongvolwassenen onder de inmates en daarna voor de rest van de inmates;
 
- Om inmates tijdig op de hoogte te stellen van de datum van hun vrijlating
 
- Om te zorgen voor een publieke telefoon, wasmachine en boeken in de gevangenis
 
- Om te zorgen dat een tandarts regelmatig de gevangenis bezoekt
 
- Om te zorgen dat de kosten van specialistische medische zorg waarvoor een doorverwijzing is gegeven, worden vergoed
 
- Om advocaten weer toe te laten tot de inmates op donderdag en bezoek vooraf te laten aankondigen met een uur.
 
Afgewezen zijn, om verschillende redenen, vorderingen met betrekking tot schorsing van de directeur, het Politiebureau, celdoorzoekingen, twee-op-een-cel, scheiden van gedetineerden, arbeid voor vrouwen en een strafkorting van 10%.
