Dismissal FWNK-director apparently unreasonable

WILLEMSTAD - The dismissal of Cesar Prince as director of Fundashon Wega di Number Kòrsou, the institution that monitors the selling of lottery tickets, is apparently unreasonable.

In this respect, the summary proceedings judge decided this morning to allow him an advance on compensation. It regards a net amount, says Prince’s lawyer, Molly Steward of VanEps Kunneman VanDoorne. Although she refused to mention the amount, she said that costs involved with that amount are for the FWNK.

The judgment is a temporary provision. The definite amount will be determined in a basic procedure. However, Steward states that Prince prefers to settle the case outside court. “This is quicker, easier and involves fewer costs for all parties. Prince wants to get this situation over and done with as quickly as possible.”

Prince had taken FWNK to court because the board had dismissed him. By letter of November 29th last year, he was informed that his employment would terminate on December 31st. Prince’s former employer accused him of unauthorized conduct, of already having reached the retirement age and dissension arose on the set-up of the Lotto. He had disagreed with the set-up and instituted legal proceedings.

During the court session, FWNK’s lawyer, Lisanne Asjes, had requested to declare Prince inadmissible, to at least dismiss his claims, because there was no question of pressing interest.

In any case, the institution doesn’t wish Prince to return because a forensic investigation is in progress and because the institution no longer trusts him, she added. Sithree van Heydoorn has meanwhile been appointed interim director.

Although the board was authorized to dismiss Prince, the question remained whether the dismissal was unreasonable. Prince had based his proposition on a continuous contract up to and including December 31st 2013. The judge stated today that this proposition was correct and that the dismissal was apparently unjust.
