Judge acquits suspect of attempted manslaughter

PHILIPSBURG--A.R. (20) was acquitted of attempted manslaughter charges during a sitting of the Court of First Instance on Thursday, November 22.

A.R. was accused of firing shots at another young man, A.V., who was hit twice in the right leg and once in the left outside a local Spanish disco on May 13, 2011. A.R.'s defence was that he had been at home that night.
 
The victim's statement read that he and the brother of the accused had had some issues beforehand and on the night of the incident the accused had pulled a gun on him and fired shots. Witnesses also placed A.R. and his brother at the scene.
 
However, A.R. insisted that he had not been there that night and that he did not own a weapon. "I'm the type of person that just goes to work and home. That's all I do," A.R. told the judge.
 
Judge Tamara Tijhuis found it strange that charges were not filed until a year after the incident, which was one of the complex elements of the case. The defence requested A.R.'s acquittal and immediate release from the Simpson Bay prison.
 
Judge Tijhuis said she believed that A.R. and his brother had been at the scene where the shooting took place, given witnesses' statements, but given the length of time between the actual act and charges being filed, the judge said guilt was not proven beyond a reasonable doubt and therefore she acquitted A.R. of all charges and ordered his immediate release from prison.
 
A.R. has been in pre-trial detention since June 18.
