Civil inquiry into energy companies

WILLEMSTAD--The Prosecutor's Office in Curaçao has asked the Joint Court of Justice to start a so-called civil inquiry into the policies and practices at the island's government-owned energy companies Acualectra, Curoil, Curgas and Refineria di Korsou.

 
This first-ever such inquiry in the Dutch Caribbean comet as the request of local pressure group "Fundashon Akshon Sivil" (FAS) and is based on the new Civil Code.
 
In addition to the companies, the probe is to look into the role of former Prime Minister and shareholder representative of Aqualectra Gerrit Schotte (MFK), former chairman of the supervisory board at Refineria di Korsou Oswald Celso van der Dijs and former chairman of the supervisory board at Aqualectra Ray Anthony Treurniet, "based on the founded complaint of FAS that they were guilty of mismanagement," the explanation states.
 
According to the prosecution, the arguments brought forward by FAS "give every reason" for such "at least from October 10, 2010, when Curaçao obtained an autonomous status within the Kingdom."
The court will now go over the documents accompanying the request and take a decision. The next step would be to install an inquiry committee.
 
The prosecution has recommended that the latter consist of people with "involvement at a distance" and the necessary expertise. To achieve such, it envisions the inclusion of some persons from outside the island with bankruptcy- and financial knowledge.
 
The law states that the cost for the inquiry in terms of compensation for the committee members, an office as well as travel and accommodations is to be carried by the government-owned companies that are being investigated.
 
Schotte, currently opposition leader, said he welcomed any investigation because his cabinet's policy had been transparent and without any hidden agendas. Van der Dijs has stated that the probe should go back to before 10-10-'10, "because that's when all kinds of strange things happened at these companies."
 
Asked by only three people are mentioned, FAS-spokesman Ruben Suriel said this was just one of many actions taken. "There are also complaints against three ministers for unlawful acts," he added.
