Draft law to ban single-use plastic bags

PHILIPSBURG--The fight to ban the importation, distribution and sale of disposable plastic bags from supermarkets, littering road sides and endangering animals on land and in the ocean has crossed another critical threshold

with the submission of their draft initiative law by independent Member of Parliament (MP) Frans Richardson and MP Johan "Janchi" Leonard of the United People's (UP) party to Parliament on Thursday evening.

It has taken just over a year to get the legislation to be written following the tabling of two motions by Leonard and Richardson during the 2012 budget debate in March 2012. The two MPs merged their motions during debate and later tabled a joint one. Both motions stemmed from constant plea from environmental groups to ban single use plastic bags.
 
The draft law will now have to follow the process through the various advisory councils for vetting before it reaches the floor of parliament for debate and approval.
 
When the law is passed, businesses will have a period of six months to transition in biodegradable shopping bags as a consideration for those who may have a large inventory of the single use bags.
 
Violators of the ban can face hefty fines of up to NAf. 1,000 per day after the transition period has expired.
 
Some plastic material that serves as direct packaging or large packaging plastics are exempted from the proposed ban. The draft bill will allow for the importation, manufacture and/or distribution and sale of re-usable, sustainable or biodegradable plastic bags.
 
The draft law is built on the premise that single use plastic bags has a negative effect on nature and are primarily made from crude oil, a non-renewable resource that also has grave environmental consequences.
 
The ban will be supervised by the Ministry of Housing, Spatial Planning, Environment and Infrastructure VROMI.
