Arrindell: unchallengged parts of the Penal Code should go into effect

PHILIPSBURG - The new Penal Code should be published and go into effect with the exception of the articles that have been challenged by the ombudsman and are under review by the Constitutional Court, according to Parliament President Gracita Arrindell.
 
Answering questions from the press on Monday about her view on the holdup of the code, Arrindell said if it becomes necessary Parliament will have to meet with Governor Eugene Holiday and Prime Minister/General Affairs Minister Sarah Wescot-Williams on the way forward.
 
Arrindell is “curious” to find out what the Constitutional Court will decide about the challenged articles. She said whatsoever the decision is Parliament will have to abide by it.
 
Parliament’s active role in the Penal Code process had been completed when the code was passed earlier this year.
Arrindell said it cannot be so that the challenge from Ombudsman Nilda Arduin-Lynch to articles in the code dealing with organised animal fights and high punishment for crimes against tourists among others would result in the entire code being put aside or further delayed from going into effect.
 
Publishing of the Penal Code as with other laws is the responsibility of the minister of general affairs. Laws are published in the National Gazette. Arrindell will look into the possibility of making the gazette available on Parliament’s website as the process to acquire a copy is lengthy.
