Kingdom Government cancels St. Maarten AMvRB

THE HAGUE--The decision to impose an Integrity Chamber for St. Maarten via a General Measure of the Kingdom Government ("Algemene Maatregel van Rijksbestuur AMvRB") has been formally withdrawn.
 
The Kingdom Council of Ministers took the decision to withdraw the AMvRB on May 29, following the May 24 agreement with the St. Maarten Government to set up an Integrity Chamber jointly and to strengthen the law enforcement sector, a Dutch Government spokesperson confirmed on Friday.
 
The Council of State has been informed of the May 29 decision of the Kingdom Government, which was formalised recently. As a result of the withdrawing of the AMvRB, which would have been imposed by Royal Decree, advice of the Council of State is no longer required.
 
The spokesperson denied the report in the Friday edition of the Antilliaans Dagblad newspaper that the AMvRB process had not been stopped and that the advice of the Council of State was still pending.
 
According to the newspaper, Dutch Minister of Home Affairs and Kingdom Relations Ronald Plasterk did not cancel the AMvRB process, because he did not trust that St. Maarten would make the July 1 deadline to approve the National Ordinance to establish the Integrity Chamber. The spokesman said this was absolutely not the case.
 
The May 24 accord, which St. Maarten Justice Minister Dennis Richardson signed on behalf of the St. Maarten Council of Ministers, states that the Netherlands and St. Maarten will jointly establish the Integrity Chamber and strengthen the law enforcement sector through a mutual agreement instead of an AMvRB.
 
The Kingdom Council of Ministers on January 30 took the decision to impose the Integrity Chamber for St. Maarten based on an AMvRB. That decision is now off the books. The Dutch and St. Maarten governments are in consultation about the execution of the May 24 agreement.
 
The Integrity Chamber will be established to improve integrity within the St. Maarten Government. The independent body will have the authority to investigate alleged cases of corruption, nepotism and other fraudulent actions by members of government and the public administration.
