Plasterk asked about Dispute Regulation

THE HAGUE--The Permanent Committee for Kingdom Relations of the Second Chamber of the Dutch Parliament has asked the Dutch Government to provide information on the proposals for a Dispute Regulation (Geschillenregeling) for the Kingdom in anticipation of a general debate in April this year.
 
The Committee sent a letter to Dutch Minister of Home Affairs and Kingdom Relations Ronald Plasterk late last week in which it requested the Minister to provide clarity on the “concrete proposals that are currently on the table” to establish a Dispute Regulation.
 
The Committee asked the Minister to include information on the position of the four governments in the Kingdom on the Dispute Regulation. So far, no agreement has been reached between the four countries on the format and the range of the Dispute Regulation.
 
Aruba, Curaçao and St. Maarten are united and jointly drafted a Kingdom Law to solve disputes of a constitutional nature between the Kingdom partners through the Supreme Court, while the Dutch Government is in favour of having the Kingdom Council of State carry out the Dispute Regulation as a temporary provision.
Delegations taking part in the Inter-Parliamentary Consultation for the Kingdom IPKO in St. Maarten earlier this month stated in the Agreements List that they were “very disappointed” about the “lack of progress” that has been made on the level of the governments to establish a Dispute Regulation.
 
The Parliaments considered this regulation to be of “crucial importance for fair and clear relations within the Kingdom” and called on the governments to take their responsibility and promptly execute the wish of the Parliaments in the Kingdom to establish a dispute mechanism.
 
In the Agreements List, the Parliaments requested the governments to present a joint proposal for a Kingdom Law no later than mid-May 2016. It was agreed that the Parliaments would ask their governments to provide a formal reaction to the IPKO Agreements List before March 31. Based on these responses, a debate will be scheduled with Minister Plasterk in the Second Chamber in April 2016.
