Curacao Governor rejects request to form interim government

WILLEMSTAD - Governor of Curacao, Frits Goedgedrag, has this week received legal advice concerning the request of 12 members of Parliament to form an interim government. On the advice of lawyers Grüning and Koeijers, the request will not be granted.

However, he indicated that the Parliament should have opportunities to consider. The governor pointed out that it is up to the members of Parliament to take steps to break current political impasse.

“In addition, the Parliament needs to have the opportunity to consider the situation. If the majority is of the opinion that an outgoing minister needs to leave immediately, it is up to the majority to adopt a motion of no confidence by formal ruling. This way, they can show that said minister does not have the support of the majority in Parliament,” he said.

According to the governor’s legal advisers, it is important that the members of Parliament jointly take responsibility for the process: “Action by the governor as [representative of the Netherlands] is still not addressed. In the interest of Curacao and its young democracy, it is desirable first to find all possible solutions. However, the governor must be considered as ‘last resort’ when the Parliament cannot solve the situation itself. He will then examine ways to restore and to ensure democracy.”

Gouverneur voert verzoek Statenleden niet uit

WILLEMSTAD – Gouverneur Frits Goedgedrag won deze week advies in over het verzoek van twaalf Statenleden, om een interim-kabinet in te stellen. Op advies van advocaten Grüning en Koeijers voert hij het verzoek niet uit. Wel geeft hij aan dat de Staten gelegenheid moeten krijgen om zich te beraden.

De gouverneur wijst erop dat de Statenleden eerst parlementaire stappen moeten ondernemen om uit de huidige politieke impasse te komen. “Daarbij dienen de Staten de gelegenheid te krijgen, en zo nodig te scheppen, zich te beraden op de ontstane situatie. Indien de meerderheid van mening is dat het merendeel van de demissionaire ministers per direct dienen op te stappen, is het aan die meerderheid om een formele uitspraak te doen door middel van het aannemen van moties van wantrouwen.” Op deze manier blijkt dat die minister van de regering Schotte niet meer de steun hebben van de meerderheid.

Volgens de adviseurs van de gouverneur is het belangrijk dat de Statenleden zelf gezamenlijk de verantwoordelijkheid nemen voor het functioneren. “Het optreden van de gouverneur als Koninkrijksorgaan is vooralsnog niet aan de orde. In het belang van Curaçao en haar jonge democratisch bestaan, is het gewenst dat eerst op landelijk niveau alle mogelijke oplossingen worden aangedragen.” Wel zal de gouverneur als ‘ultimum remedium’ (laatste redmiddel) optreden wanneer de Staten de situatie zelf niet kunnen oplossen. Hij zal dan de mogelijkheden onderzoeken om de democratie te herstellen en te garanderen.

Deze bijeenkomst werd buiten het parlement om gehouden. Het is nog onduidelijk of de vergadering een legale basis heeft.
