WILLEMSTAD--The recent detention in St. Maarten of former police officer Rogelio Gregory Koeiman based on an extradition request from American authorities was unlawful, stated the Joint Court of Justice in Curaçao. The panel of judges agreed with the proposition by lawyers Marije Vaders and Eldon "Peppie" Sulvaran.

LUXEMBURG - Nederland mag downloaden uit illegale bron niet meer toestaan. De thuiskopieheffing, die houders van auteursrecht hiervoor moest compenseren, is onvoldoende. Dat oordeelt het Europees Hof van Justitie vandaag.

LUXEMBURG - De Europese bewaarplicht, de wet die het bewaren van communicatiegegevens voorschrijft, is in strijd met het Europees recht en is per direct ongeldig verklaard. Dat heeft het Europese Hof van Justitie vandaag geoordeeld. De uitspraak zet het gebruik van metadata op losse schroeven.

Het Gemeenschappelijk Hof van Justitie van Aruba, Curaçao, Sint Maarten en van Bonaire, Saint Eustatius en Saba heeft een onderzoek bevolen naar het beleid en de gang van zaken bij fiscalistenkantoor Taxand Curaçao. Als onderzoeker is Leo Spigt van Spigt Litigators in Nederland aangesteld. Hij zal het exacte reilen en zeilen binnen Taxand Curaçao vanaf 31 december 2010 onder de loep nemen.

WILLEMSTAD — Xerxes ‘Checo’ Nepomuceno, ex-voorzitter van de Freezone Association of Curaçao (FrezaCur) en zijn bedrijf zijn door de rechter vrijgesproken van het invoeren, doorvoeren of in het bezit hebben van vervalste merkproducten in juni vorig jaar. Het Openbaar Ministerie eiste tijdens de behandeling van de zaak op 14 februari, in totaal 250.000 gulden boete tegen de man en zijn bedrijf.

Court: Government must occupy new building within 12 months

PHILIPSBURG--The Government of St. Maarten must start occupying its new government building within 12 months, the Court of First Instance has ruled. The new building, which was completed in 2008, has largely been empty whilst the government has rented various other buildings from which it has been operating.

PHILIPSBURG--An historical event occurred yesterday in the Courthouse when the Constitutional Court of St. Maarten delivered its judgement in the first-ever case filed by Ombudsman Nilda Arduin. Arduin had filed seven complaints with respect to the Criminal Code. Four of these complaints were considered well-founded.
Standard Trust director guilty of mismanagement

PHILIPSBURG – The Court in First Instance has found Corinne de Tullio-Stamm guilty of mismanagement and holds her responsible for the complete deficit in the bankruptcy of Yordan Busarov’s Evmolpia Private Foundation. The court sentenced De Tullio-Stamm to pay the trustees in the bankruptcy, Hendrich Seferina and Maarten Le Poole of HBN Law an advance of 200,000 guilders on the deficit that could run into the millions of dollars.
RBC Bank takes its distance from Corallo-companies

PHILIPSBURG – RBC Royal Bank does not have to restore its relationship with Francesco Corallo’s Atlantis World Management NV and two related companies, the Court in First Instance ruled. RBC terminated the relationship due to the negative publicity surrounding Corallo about his alleged links to the Italian mafia and his possible involvement in criminal behavior.
Parents lose court case, 13-year-old must shave

PHILIPSBURG--A 13-year-old boy, whose parents filed a court case against Learning Unlimited (LU) over a dispute as to whether the boy should shave off his moustache, has been ordered to follow the regulations set by the school. His parents lost the court case they filed against the school, and were ordered to pay NAf. 1,000 in costs.
