Als u niet meer samen verder wilt met uw partner, kunt u de samenwerking beëindigen. Omdat de samenwerking plaatsvindt in een BV of NV kunt u dit niet doen door het opzeggen van een samenwerkingsovereenkomst.

Curacao Legal Portal annually composes a ranking of Curacao based law firms based on the number of lawyers employed on Curacao. Stunning conclusion is that two out of the top five largest law firms decrease in size (on Curacao). At the same time, only one firm in the top of the ranking is growing significantly.

Language is the instrument par excellence of the advocate (attorney; lawyer). He uses language to lay down agreements, to provide legal advices, to formulate Court documents, to send demand letters, to make his plea or to conduct talks with clients or counterparties, to send invoices, in short: to practice his profession.

A sensitive subject
The advocate (attorney; lawyer) as orator is a sensitive subject. Many clients will have listened with curled toes or alternatively with a deep feeling of embarrassment to their own advocate or (if they are lucky) to that of their counterparty at the moment suprême when the so-carefully prepared written summary of the argument is read out dryly and stumbling over the words or at least in a scarcely inspiring manner.

Ultra vires means ‘beyond power or authority’. An ultra vires act is one beyond the purpose clause as laid down in the Articles of Association of a legal entity, for instance a foundation or a limited liability company (NV or BV).

Zoals eerder bericht had het Gerecht in Eerste Aanleg van Curacao op 24 november 2009 op mijn verzoek in kort geding een koper veroordeeld om een onroerend goed af te nemen en de koopprijs van bijna een miljoen Nederlands Antilliaanse guldens te betalen.
